Terms of Service

These terms govern your use of the Awhile iOS and Android application published by ARCKONE SRL (Tournai, Belgium). By installing or using Awhile, you agree to them.

1. What Awhile is

Awhile is an independent focus tool. It loads instagram.com inside a standard mobile WebView and applies cosmetic CSS rules that hide selected sections (feed, Reels, Explore, Stories) on the user’s own device. Awhile does not access, store, transmit, scrape, or interact with any Instagram API or any Instagram user data. Awhile does not provide any automation of Instagram interactions (no auto-likes, auto-follows, auto-posts, auto-comments, scraping, or bulk actions).

Awhile is not affiliated with, endorsed, sponsored, or operated by Meta Platforms, Inc., Instagram LLC, Apple Inc., or Google LLC. See the Legal notice for the full trademark and independence statement.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Awhile on iOS or Android devices you own or control, subject to the Apple Media Services Terms and Conditions and the Google Play Terms of Service.

3. Trademarks

Awhile™ is a trademark of ARCKONE SRL. Instagram and the Instagram logo are trademarks of Instagram LLC. Meta is a trademark of Meta Platforms, Inc. All other names, logos and brands are the property of their respective owners. Any reference to Instagram in Awhile or in its marketing materials is made under the principle of nominative fair use solely to describe the third-party service that users may choose to access through Awhile’s browser.

5. Your responsibility for your Instagram account

You access Instagram through Awhile using your own credentials. Your use of Instagram, the content you view or post, and your compliance with Meta’s terms remain your sole responsibility. ARCKONE SRL has no control over Instagram, no visibility into your Instagram account, and no ability to influence Meta’s moderation, enforcement, or account-suspension decisions.

To the fullest extent permitted by law, ARCKONE SRL accepts no responsibility for any restriction, suspension, or termination of your Instagram account that may result, directly or indirectly, from your use of Awhile or from any change Meta may make to its services or policies.

6. Premium purchase

Premium is a one-time in-app purchase of 9.99 EUR (price may vary by region). The purchase is non-subscription: it does not renew automatically. Refunds are handled by Apple under their App Store refund policy and by Google under the Google Play refund policy. We have no direct ability to issue refunds for store purchases.

7. Availability and updates

Awhile is provided as-is. Because Instagram’s HTML/CSS structure can change without notice, individual filters may occasionally break between Instagram updates. We ship corrected selector lists over-the-air as quickly as we can, but we do not guarantee any specific filter will remain functional indefinitely. We further reserve the right, at our sole discretion and at any time, to modify, suspend, restrict, or discontinue any feature of Awhile (including, without limitation, the cosmetic filtering of any specific section of Instagram) if Meta modifies its services or policies in a way that makes that feature incompatible, infeasible, or otherwise inappropriate to maintain.

8. Limitation of liability

To the fullest extent permitted by Belgian law, ARCKONE SRL shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of Awhile, including but not limited to suspension or termination of your Instagram account, loss of access to or data on any third-party service, lost time, lost goodwill, or business interruption.

Our aggregate liability for direct damages shall not exceed the amount you paid for Premium in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold ARCKONE SRL harmless from any claim or demand made by a third party (including, without limitation, Meta Platforms, Inc., Instagram LLC, Apple Inc., or Google LLC) arising out of (a) your breach of these terms, (b) your violation of any law, or (c) your infringement of any third-party right, including Instagram’s own Terms of Use.

10. Termination

We may terminate this licence if you breach these terms. You may terminate it at any time by uninstalling Awhile from your device.

11. Force majeure

ARCKONE SRL is not liable for any failure or delay to perform its obligations under these terms when caused by events beyond its reasonable control, including acts of God, network outages, third-party platform failures (Apple, Google, Meta, hosting providers), governmental measures, or war.

12. Intellectual property notices

Notices of alleged intellectual property infringement or other legal requests should be sent to hello@awhile.app. See the Legal notice, section 8, for the procedure under Article 16 of the EU Digital Services Act.

13. Severability and entire agreement

If any provision of these terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. These terms, together with the Privacy Policy and the Legal notice, constitute the entire agreement between you and ARCKONE SRL regarding Awhile, and supersede any prior agreement.

14. No waiver

Failure by ARCKONE SRL to enforce any right under these terms shall not constitute a waiver of that right or any other right.

15. Governing law

These terms are governed by Belgian law, subject to mandatory rules of European consumer law. Any dispute shall be submitted to the courts of the judicial district of Hainaut, division Tournai, Belgium, without prejudice to mandatory consumer protection rules of your country of residence.
